TabHerdAI

TabHerdAI terms of service

Effective October 26, 2026.

These terms are a contract between you and Mark Morrison ("we", "us"), the maker of TabHerdAI, for your use of the TabHerdAI Chrome extension, the TabHerdAI Plus service, and the tabherdai.com website (together, "TabHerdAI"). By installing the extension, buying Plus, or using the site, you agree to them. If you don't agree, don't use TabHerdAI.

1. What TabHerdAI is

TabHerdAI is a browser extension that organizes, archives and closes your browser tabs, with optional AI features that suggest what to keep, archive or close. The free features work without an account. The AI features need either TabHerdAI Plus, an API key of your own, or a local model you run yourself.

2. Your license to use the extension

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the extension on browsers you control. You may not copy, modify, redistribute, sell, reverse-engineer or create derivative works from it except where the law allows it regardless of this term, or where the source is published under an open-source license that says otherwise.

3. TabHerdAI Plus

4. Acceptable use

Don't use TabHerdAI to break the law, to send content to the AI services that violates their policies, to attack or overload our server, to get around trial or usage limits, or to extract our service for use in another product. We can suspend or end access for abuse, and we will tell you why unless the law prevents it.

5. AI features

The AI features make suggestions. They can be wrong: they may misjudge what a tab is for, write an inaccurate note, or propose closing something you need. You decide what to apply, and TabHerdAI records every change so it can be undone. We are not responsible for decisions you make based on AI output. AI output is not advice.

When you use your own API key or a local model, the provider's terms apply to that use and we are not party to them.

6. Your data

Our privacy policy explains what data TabHerdAI handles and is part of these terms. In short: your tab data stays in your browser; it is sent to an AI service only with your consent; our server stores hashes, not keys or content.

Your tabs, archives and notes are yours. We claim no rights in them.

7. Availability and changes

We work to keep Plus available but can't promise it will be uninterrupted, and we are not liable for downtime caused by Cloudflare, Google, Lemon Squeezy or your network. We may change or discontinue features. If we discontinue Plus, we will refund the unused part of any subscription.

8. Warranty disclaimer

TabHerdAI is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some places don't allow this, so parts of it may not apply to you.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from TabHerdAI. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $10 if you paid nothing. Nothing in these terms limits liability that can't be limited by law, including for fraud or for death or injury caused by negligence.

10. Consumers

If you are a consumer in the EU, EEA, UK or another place with mandatory consumer protection law, nothing in these terms takes away rights that law gives you, including statutory warranties and your right to bring a claim in your own country's courts. The refund in section 3 is in addition to, not instead of, your legal right of withdrawal.

11. Termination

You can stop using TabHerdAI at any time by uninstalling it; that deletes its data from your browser. We can end these terms if you break them. Sections 5, 6, 8, 9 and 12 survive termination.

12. Governing law and disputes

These terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law rules, and disputes will be brought in the courts there, except where section 10 gives you the right to use your own courts. Before going to court, email us and we will try to sort it out within 30 days.

13. Changes to these terms

We may update these terms. The date at the top changes when we do. For material changes we will give at least 14 days' notice in the extension's release notes and, where we have your email from an order, by email. Continuing to use TabHerdAI after that means you accept the new terms; if you don't, cancel before they take effect and we will refund the unused part of your subscription.
